In the latest bold judicial jurisprudence witnessed by the “family judicial” court of first instance in Rabat, which observers and interested parties have considered a quiet judicial revolution in the Kingdom, and which is also considered a precedent of its kind in the courts, the family court of the aforementioned court refused to force his wife’s husband to have sex, after the man filed a complaint against her, accusing her of refusing to have sex with him.
Explaining the court’s decision, he said: “Islamic law has not made ba’ah merely an instinct and a passing act, but rather linked it to the etiquette of sexual intercourse that must be observed by both spouses when the atmosphere between them is clear. (…) Therefore, forcing a woman to have sexual intercourse contradicts the purpose of marriage.
