The HIBAPRESS newspaper received a statement of fact issued by Professor Hussein Al-Fahimi, a lawyer admitted to the Court of Cassation, in which he denounced the statements made by the President of the Nador Regional Council during the session of April 28, 2026; the lawyer considered that the President's attempt to cancel the defense agreement concluded with him was nothing more than an attempt to evade responsibility for "serious violations" that harmed the finances of the Regional Council and the Nador prefecture.
The statement confirmed that the President tried to mislead public opinion and the Council by claiming that the financial losses were due to "physical assault" lawsuits related to the orbital road, while the truth – according to the language of the statement – lies in the President's deliberate freezing of expropriation procedures for years, for purposes that serve his "personal gain" and undermine the interest of the public facility he represents.
Lawyer Al-Fahimi revealed that this deliberate freezing prevented the activation of Article 37 of the Urban Planning Law, which exempts the administration from paying compensation if the deducted part does not exceed a quarter of the area of the property; explaining that completing the legal procedures would have been sufficient to exempt the Council from paying huge amounts, but the President's approach led to the issuance of judicial rulings to pay in favor of property owners unnecessarily.
The statement revealed a heavy numerical surprise when it accused the President of deliberately causing a financial loss estimated at 1.3 billion centimes (13,000,000 dirhams), which are amounts that were ruled against the Council as a result of the disruption of the expropriation procedure since 2019, stressing that these figures reflect a clear mismanagement that amounts to the degree of "crimes" against the region's budget.
The lawyer condemned in his statement the position of the members of the Regional Council who did not demand that he be confronted with the accusations against him, considering that objectivity required presenting concrete files as examples to determine the real person responsible for the loss of those funds, and whether the negligence came from the defense institution or is the result of the President's pursuit of the private interests of property owners.
Professor Al-Fahimi concluded his statement by directing a direct and explicit challenge to the President of the Regional Council, inviting him to hold a "public confrontation" in which all files and documents would be placed on the table in front of everyone; in order to reveal "right from wrong" and show the party that deliberately harmed the Council's finances, concluding his statement with a Quranic warning to the oppressors, which indicates an expected legal escalation in this case.
The Nador Regional Council had ratified in its last session the termination of the agreement that links it to Professor Al-Fahimi by the end of 2025, where the President justified this decision by holding the lawyer responsible for losing cases that resulted in heavy financial burdens that should have been directed to development projects, indicating that the dismissal came after explanatory letters and repeated absences, while considering communication with members to influence the attendance of the session an unacceptable behavior; these are the accusations that sparked a heated discussion after the counselor "Dina" inquired about the circumstances of the file and the determination of responsibilities for this financial hemorrhage.
