The Ministry of National Education, Primary Education and Sports published a ministerial note which it distributed to the heads of its central, regional and regional directorates, through which it calls for allowing teaching staff in education public to work overtime in private educational establishments through an initial license issued at the end of June of each academic year as the maximum deadline, and a final license before the end of September of each academic year.
The ministry based its decision on a series of legal references, notably Law No. 06.00 concerning the basic system of private school education, promulgated and implemented by Royal Decree No. 2000. 1.00.202 of 15 Safar 1421 (19) May, and Framework Law No. 51.17 relating to the education, training and scientific research system, Prime Minister’s Circular No. 2952 of November 30, 2000 relating to the combination of employment and free activities.
The ministry stipulated a series of provisions, including:
* At the level of the educational establishment: The teacher submits a request for initial authorization to work overtime in private educational establishments to the director of the public educational establishment in which he works, and it is approved by the educational director. of the educational establishment. The information in which he wishes to work overtime, including his own data and the information of the educational institution, the name of the institution, its address, its license number and date, the educational subject and the number of hours he wishes to complete. Considering the approval of the application by the educational director (a) of the private educational institution as confirmation of the validity of the institution’s data included in the application, the application is submitted during the period from April 1 by May 15 of each academic year. year, and any application received outside this deadline is considered null and void.
The director of the public educational establishment studies the application and expresses an opinion of approval or rejection, taking into account the best interests of the students of the public educational establishment in which the professor is applying, especially if these hours are worked outside. the official working hours of the teacher. The public educational establishment is not required to use its services to complete overtime, while respecting the half-days allocated to educational meetings and seminars.
The director of the public educational establishment sends the request to the regional management, no later than May 20 of each academic year, while keeping copies of the requests presented in this regard in a special file for the establishment.
The director of the establishment also endeavors, during the school year, to transmit monthly to the regional management a list of teaching staff authorized to provide overtime in private educational establishments.
* At the regional management level:
The Regional Directorate studies the applications, on the basis of the following elements:
_ Opinion of the director of the public educational establishment. _ The validity of the data contained in the request _ The number of hours that can be authorized must not exceed eight (8) hours per week for each professor: Higher institutes and preparing departments. for the higher technical certificate by working overtime in private establishments outside the regional education and training academy to which they belong, after advice from the central services responsible for supervising the preparatory departments for institutes and higher schools and the preparation departments. the Higher Technical Certificate._ Possibility of accreditation, when necessary and exceptionally, for secondary education teachers. Distinguished education and training teachers working in secondary education will work overtime in the preparatory departments of institutes and higher schools and in the preparation departments for the private high-tech certificate, after having taken the advice of the central services responsible for supervising the preparatory courses. the departments of institutes and higher schools and the high technology certificate preparation departments.
– In the event that the approved teacher (ha) is not able to continue to perform his duties (ha) in the private educational establishment for whatever reason, his educational director may submit a request for replacement from him (ha) according to the same procedure followed. in the first license, except for compliance with the specified deadline for creating requests.
Based on the elements specified above, the Regional Directorate endeavors to express an opinion on the approval or refusal of applications and directs them towards the Regional Academy of Education and Training in order to obtain the required initial licenses, no later than the end of May 2019. each academic year.
This, knowing that any rejection of a request to work overtime in private educational establishments must be justified.
* At the level of the Regional Academy of Education and Training
The Regional Academy of Education and Training is working to obtain the first authorizations to work overtime in private educational establishments on the advice of the Regional Directorate and issues them to interested parties through the scale administrative, no later than the end of the month of June for each academic. year.
* Definitive license:
The request for definitive authorization to work overtime in private educational establishments is submitted according to the same procedure applied in the initial authorization, accompanied by a copy of the initial authorization and the course schedule in the public and private establishment, before the month of September. 15, and the final license of teachers is obtained before the end of September of each academic year.
Working overtime in private educational establishments requires compliance with the following controls:
**For public education executives:
– Do not work overtime in private educational establishments without obtaining authorization to do so, and do not engage in activities of this type in non-approved establishments. – Limit the license to work overtime to the private educational institution covered by the license.
– Do not exceed the authorized number of hours.
– The educational field concerned by overtime is identical to the educational field in which the teacher works in public education, as well as the subject of specialization.
The time interval between working hours in the public educational establishment and in the private educational establishment shall not be less than one hour, and the number of working hours in the two establishments together shall not be should not exceed six hours per day, in order to avoid fatigue and ensure productivity.
– Do not work overtime in the private educational establishment in cases where the teacher is the beneficiary of an administrative or sickness authorization, a paternity authorization or a birth authorization for the employee, or is absent from work at the public educational institution for any reason. .
The ministry stressed that anyone who does not comply with the controls specified above will have their license withdrawn and will also be considered to have failed to fulfill their professional obligations stipulated in Royal Decree No. 008-58-1 of 4 Shaban 1377. (February 24, 1958) as the general statute of public employment, and is exposed to the disciplinary sanctions contained therein.
** For private educational establishments:
It is only possible to benefit from the services of public education teaching staff after obtaining a written license.
The total number of public education teachers authorized to work overtime in the institution must not exceed 20% of the total secondary education teaching staff on Wikimedia Commons.
