The Court of Appeal in Beni Mellal issued a ruling sentencing the accused to five years in prison, on the basis of a case related to the sexual assault of a young woman with a mental disability, which occurred in one of the villages of the "Bouidmouma" region near Aghbala, an incident that resulted in pregnancy and childbirth.
The judicial body, during a session held on Tuesday, May 12, decided to oblige the convicts to pay the costs of the lawsuit, while enabling them to appeal through the appeal procedure. The court also ruled in the civil aspect to pay compensation in favor of the victim, which was set at 20,000 dirhams jointly among the accused.
The court had previously ordered a genetic (DNA) test to identify the biological father of the child, and set the cost of the test at 5,000 dirhams, obliging the accused to deposit the amount in the court fund within a period not exceeding one week, in order to enable the National Laboratory to carry out the necessary tests.
The details of the case go back to a young woman with a mental disability, who was subjected to two sexual assaults at different times, which resulted in the birth of two children; one of them is about eight years old, while the second child is still in his first year.
