HIBAPRESS – Al Hoceima
The regional leadership of the National Rally of Independents party is heading towards the judicial path to challenge the election of Najma Amazghar as president of the Ait Qamra commune council in the province of Al Hoceima, in light of her party and electoral record during the previous elections.
According to information from media sources, the party intends to approach the Administrative Court in Fez to demand the stripping of Amazghar's membership in the communal council. This is on the grounds that she ran in the 2021 elections under the banner of the National Rally of Independents party, before running in the recent elections under the Authenticity and Modernity Party, with which she won the presidency of the commune.
Najma Amazghar was elected, on October 8 of this month, as the new president of the Ait Qamra commune, following the vacancy of the presidency after the death of former president Mohamed Allawi. She thus became the first woman to hold the presidency of the commune since its establishment. Her election came after competing with Sadik Asrih from the Socialist Union of Popular Forces party and Ismail Belhasan from the National Rally of Independents party.
The discussion related to the case is based on the legal provisions governing the party affiliation of elected officials, particularly Article 51 of Organic Law No. 113.14 concerning communes. However, the application of these provisions remains subject to judicial interpretation and the precise facts of the case, and the legal text has seen intervention from the Constitutional Council regarding some of its provisions.
Therefore, any talk of Amazghar losing her membership or her election being void remains, at the current stage, merely a request or an attempt to challenge until the competent judicial authorities make their final decision.
This development opens the door to a new legal and political confrontation over the presidency of the Ait Qamra commune, pending the outcome of the procedures that the National Rally of Independents party may initiate, and what the competent court will decide regarding the legality of the challenge and its grounds.
