The Court of Appeal for Criminal Cases at the Court of Appeal in Fez decided this Thursday morning to continue the proceedings in the case of the murder of leftist student Mohamed Benaisa Ait El Jed, by dispensing with the testimony of the prosecution witness Al-Khimar Al-Hidiwi, and considering the file in which the leader of the Justice and Development Party, Abdelali Hami El-Din, is being prosecuted, ready for discussion.
This decision came after a discussion between the court and the defense teams regarding the witness's absence from the session. After the civil party's defense presented a medical certificate to justify his absence, the latter urged for the discussion to be postponed until he could be heard.
In contrast, Hami El-Din's defense opposed the postponement request, pleading for the case to be considered ready for discussion. This move led to the rejection of the delay request and dispensing with hearing the mentioned witness.
The session, presided over by Counselor Mohamed Amzian, witnessed a legal debate about the submitted medical certificate. Lawyer Omar Hallawi, a member of Hami El-Din's defense team, raised the issue of the civil party's defense's right to submit a medical document concerning another person, considering it a legal issue that requires attention.
