“Heba Press” learned from a well-informed source that the Administrative Court recently issued a judgment in favor of an employee working at the Regional Directorate of Equipment, Transport and Logistics in Al Hoceima, against the backdrop of an order from the Ministry to arbitrarily transfer her to the Province of Driouch without legal basis and justifications.
The same sources add that the court considered that the administrative decision issued by the authority concerned was not based on clear legal reasons and justifications, which constitutes a violation of the employee’s rights.
The details of the case date back to an earlier period when the employee, who at the same time holds the position of general secretary of the regional branch of the National Equipment Union affiliated to the UMT, filed a complaint against her transfer decision signed by the Minister of Equipment and Transport, Nizar Baraka, considering it unjustified and because of this she exposed herself to moral and professional harm, and after examining the court, based on the evidence and testimonies presented before it, it decided to cancel the administrative decision and return the employee to her original position at the Equipment Directorate of Al Hoceima.
The university office of the same administration, which comes under the Moroccan Labor Union, had condemned in a statement the decision to transfer the employee to the Driouch region, which it considers unjustified, warning the Ministry of Supervision against the corruption of lobbies that exploit public facilities and influence to settle personal scores.
