Lawyer Abdel Kabir Tabih, former chairman of the Justice and Legislation Committee in the House of Representatives, noted that the draft law on civil procedure includes articles in this bill which constitute a violation of the Constitution, and he said that this bill does not make sense.
Tabih, who spoke yesterday Friday at the press conference organized by the Association of Lawyers for Justice, declared: “The uprising of jurists in the face of the debate on civil procedure is a gesture that must continue,” adding : “Today’s battle in the area of justice legislation is a battle of blatant violation of the constitution.
The same spokesperson confirmed that the government majority did not vote on this bill, indicating that out of 292 votes only 103 voted, adding: “This project should have been withdrawn if we were in another country. Your government majority did not accept the project. .”
Lawyer Tabih criticized the talk that Parliament has discretionary power, pointing out that it is a “strange word that only means dictatorship.” He stressed that no body enjoys this power, including the correctional judicial power, considering that with these texts, “it does not seem that the government is operating within the limits of the 2011 Constitution”.
He added: “We have a constitution that is beyond us and it does not confer any discretionary powers on the government or parliament. There is a specific ceiling,” emphasizing that the constitution makes citizens equal before the rule of law. , and made them equal before the law with the three authorities executive, legislative and judicial. We cannot therefore accept that the arrest of execution decisions pronounced against the administration when the latter resorts to the veto and that the citizen does not enjoy the same right. Tabih considered that “this is a violation of the Constitution and the principle of equality before the law”.
