The Minister of Economic Inclusion, Small Business, Employment and Skills, Younes Sekkouri, affirmed, Monday in the House of Representatives, that the dialogue with the unions continues with a view to reaching a consensual formula on the draft regulatory law relating to the conditions and modalities for exercising the right to strike.

Responding to questions on “the regulation of the exercise of the right to strike and the revision of the labor code”, during the oral questions session, Mr. Sekkouri indicated that around thirty meetings were held with the unions .

He noted that these meetings are still continuing to reach a “deep” preliminary agreement with the unions on the said regulatory law, before moving to the stage of examining this project in the House of Representatives.

The minister expressed his hope of reaching a consensus with the unions to adopt a law on strikes likely to “guarantee the rights of workers and employers and the balance between rights and duties”.

He considered that the objective is to demonstrate to the international community that “the right to strike in Morocco is exercised in accordance with controls which guarantee rights and duties”.

“An important social agreement was signed by the government for the implementation of the agreement of April 30, 2022,” he added, maintaining that the law on the exercise of the right to strike is “guaranteed by the international labor legislation and the Moroccan constitution.

Mr. Sekkouri stressed that the right to strike should not be limited, but must be exercised fluidly as a legitimate means of pressure to assert the rights of workers in the private and public sectors.

He insisted on the fact that this right must be exercised without prejudice to employers who respect the rights of workers, observe collective labor agreements and do not infringe on the freedom of union activity.

The right to strike must be in line with the provisions of the constitution, accessible to all, with clear reasons, exercised in good faith, with a precise negotiation deadline, he noted.

Because, he explained, it is “a protest file requiring a budgetary study”, given that certain strikes are justified by disagreements with employers who do not respect workers’ rights.

Regarding the labor code, Mr. Sekkouri affirmed that the government is determined not to delay its implementation, expressing his wish to see the laws agreed with the unions, especially since he These are “societal questions that transcend political sensitivities”.
