HIBAPRESS – Marrakech. Informed sources mentioned that the Public Prosecutor's Office at the Court of Appeal in Marrakech decided to issue an order for the temporary suspension from work of a notary practicing his duties in the city of Marrakech, within the framework of a legal procedure related to actions attributed to him.
According to the data of the decision, the measure that concerned the notary was based on the provisions of Law No. 09.32 regarding the organization of the notarial profession, especially Article 78 of it, and after reviewing the investigation report prepared by the judicial police in Marrakech. This decision comes against the backdrop of a complaint submitted by a company regarding the suspicion of destruction and squandering of an official and check document, actions for which legal follow-up and judicial investigations were opened under the supervision of the competent Public Prosecutor's Office. The sources confirmed that the notary in question submitted a request to conduct an investigation against him in order to respond to what was attributed to him of obligations and documents, in accordance with the provisions of Article 592 of the Penal Code, pending the results of the judicial investigation. It was decided to refer the file to the specialized committee stipulated in Article 11 of the law organizing the notarial profession, with the emphasis that the suspension decision remains temporary until a final decision is issued on the matter, whether by not pursuing the case or by issuing a judicial ruling that has the force of res judicata. The Public Prosecutor's Office stressed that this measure falls within the framework of protecting public trust, the stability of transactions, maintaining the ethics of the profession, and ensuring contractual security for those dealing with the notarial profession.
