HIBAPRESS – Mohamed Zariouh
In a strong media appearance, the First Vice President of the National Authority for Adouls, Hussein Al-Dendi, revealed in a special statement to HIBAPRESS, the extent of the anger prevailing among the Adouls due to the draft law No. 16.22, stressing that the Authority's demands are "clear and legitimate" and no longer accept further disregard.
Al-Dendi emphasized that the Adouls are demanding urgent intervention from the Head of Government in order to withdraw the draft or at least freeze it, until a new legislative text is prepared that guarantees contractual and documentary security and protects the rights of contractors and professionals alike. He explained that the National Authority for Adouls does not oppose reform, but refuses the passage of a legal text that does not respond to the reality of the profession and does not keep pace with the real constraints experienced by the Adouls in the field, adding that any serious reform must establish a sound professional environment, making the justice institution a real safety valve in the documentation system, and not turning it into a weak link burdened with burdens and responsibilities. The speaker confirmed that the current form of the draft law imposes heavy obligations on the Adoul, including the duty of advice and achieving the result when documenting transactions, especially those related to the preserved or in-the-process-of-preservation property, considering that these provisions place the Adoul before serious responsibilities without providing him with sufficient legal and professional mechanisms to protect him and help him perform his duties in sound conditions, which may reflect negatively on the profession and on the documentary security itself. In this context, Al-Dendi highlighted that the Authority submitted many proposals and observations during a series of meetings with various parliamentary groups, whether from the majority or the opposition, indicating that the discussion on the project witnessed prominent stations, including the two study days organized in the House of Representatives by the Justice and Development Party team and the second by the Justice, Legislation and Human Rights Committee, which are meetings that showed political and legislative interaction with a number of the Adouls' demands. The First Vice President of the Authority added that the majority parties adopted 49 amendments, while the opposition parties submitted more than 200 amendments, all of which were directed towards one goal, which is to formulate a legal text that achieves the interest of the affiliates and is accepted by the professionals. But the surprise, in his words, was in rejecting most of all the فصلية proposals, and settling for only some minor amendments that do not touch the essence of the project and do not respond to the Authority's basic demands. Hussein Al-Dendi concluded his statement by emphasizing that the demands of the National Authority for Adouls are not sectarian or circumstantial, but are just demands consistent with the spirit of the 2011 constitution and the recommendations of the deep and comprehensive reform of the justice system, which received the high care of King Mohammed VI, stressing that the Authority will continue to defend the profession of judicial documentation by all legitimate means, in order to bring out a modern and fair law, that cuts off the imbalances of Law 16.03, and restores confidence to this vital workshop.
