HIBAPRESS – Fikri Ouldali
The Administrative Court of Fez issued a final ruling in favor of a teacher working under the jurisdiction of the Regional Directorate of the Ministry of National Education, Preschool, and Sports in Al Hoceima, following a judicial appeal filed against an administrative decision that he considered unfair to him during the management of the regional transfer movement.
The facts of the case go back to the exclusion of the teacher in question from benefiting from the transfer to an educational institution in Al Hoceima, on the pretext of not registering any shortage there, according to what was announced by the Regional Directorate. However, the surprise emerged later, when the same position was assigned to another teacher within the framework of what is known as "assignments", which the affected person considered a clear contradiction that strikes at the heart of the principle of equal opportunity and transparency in the management of human resources. The judicial appeal was based on a violation of the provisions of Ministerial Memorandum No. 25/63 and Framework Memorandum No. 71/22, which frame the transfer operations and administrative management within the sector, which prompted the court to issue its ruling in favor of the teacher, in a step that strengthens judicial oversight of administrative decisions and enshrines the principles of fairness and good governance.
