HIBAPRESS – Rabat

The sworn clerks attached to the offices of judicial commissioners in Morocco held a protest on Friday in front of the Ministry of Justice headquarters in Rabat to express their dissatisfaction with a number of professional and legal issues that they said had remained unresolved.

The protesters, who are under the banner of their trade union framework, raised a set of basic demands, foremost of which was the call to activate the provisions of Article 6 of Law No. 46.21 regulating the profession of judicial commissioner, which stipulates exempting sworn clerks with a seniority of no less than ten years and who hold a bachelor's degree from passing the entrance exam to the profession. They also emphasized the need to adopt greater flexibility in accessing the legal profession, given that a number of sworn clerks have academic training and significant professional experience within the courts, considering that adopting the principle of professional gradation would enhance efficiency within the justice system and ensure equal opportunities. The protest noted a warning about what the participants described as the lack of balance between the seriousness of the tasks undertaken by the sworn clerk and the limited legal and social guarantees granted to him, in light of the nature of work that involves multiple field risks. In the same context, the protesters pointed to the constraints associated with judicial notification operations, including the absence of insurance against traffic accidents, the lack of special legal protection, as well as the possibility of being assaulted while performing tasks. The sworn clerks also demanded the provision of health coverage and the benefit of insurance against work accidents, calling on the supervisory authorities to seriously interact with these demands, in order to avoid the exacerbation of tension within this sector, which they considered a fundamental link in the functioning of the justice facility.
