HIBAPRESS – Rabat
The Ministry of Health and Social Protection issued a circular dated October 3, 2025, addressed to pharmacists in charge of pharmaceutical establishments, urging them to strictly adhere to the legal and regulatory provisions related to the sale of medicines to private clinics and similar institutions.
The ministry emphasized in this circular that some pharmaceutical establishments do not comply with the laws in force, by engaging in a number of violations, including selling medicines to clinics at the public sale price (PPV) instead of the hospital price (PH), providing discounts or free units, as well as participating in tenders specific to clinics, and not providing medicines designated for sale at the hospital price as stipulated by law. The ministry clarified that these practices constitute a violation of the provisions of Law No. 17-04, which is considered the Drug and Pharmacy Code, especially Articles 72 and 73, where the first requires private clinics to procure directly from industrial pharmaceutical establishments and distributors at the hospital price (PH), while the second prohibits the delivery of medicines or pharmaceutical products free of charge or outside the therapeutic framework. The Ministry of Health stressed that industrial pharmaceutical establishments and distributors are required to invoice exclusively according to the hospital price specified by law, with the need to label all medicine boxes intended for clinics with the phrase "Hospital Price (PH)". The ministry concluded its circular by confirming that it, in coordination with the Moroccan Agency for Drugs and Health Products, will enhance strict monitoring mechanisms for these provisions, while taking all legal measures against anyone proven to be involved in violating these regulations.
