HIBAPRESS – Mohammed El Herwali

Under the supervision of Mostafa Ait Haloui, the First President of the Court of Appeal in Marrakech, a training session was organized today, Tuesday, November 25, 2025, for the benefit of judges and counselors of the judicial circuit of the Court of Appeal in Marrakech, focusing on the topic: "The practical and legal difficulties of enforcing judicial rulings, with restoring the situation to its original state."

The work of this training session was chaired by Mohammed El Amin El Jabri, the Vice-President of the Court of Appeal in Marrakech, who emphasized in his opening speech the importance of training and qualifying actors in the field of justice, especially at the level of the practical and legal difficulties of enforcing judicial rulings, because of its direct impact on ensuring legal security and protecting the rights of individuals and groups.

He affirmed that this training session aims to deepen the discussion on the problems that accompany the implementation phase, considering it the most important stage in achieving justice, due to the practical and legal challenges posed by the enforcement of rulings, which require a precise approach and coordination between various stakeholders.

Professor Zakaria El Hashemi, a judge at the Ibn Jarir Primary Court, oversaw the training, analyzing the issue of restoring the situation to its original state, and the complications that this procedure raises related to the reality of the files and the diversity of disputes.

He pointed out that restoring the situation to its original state is one of the most complex enforcement orders in the judicial system, due to the practical and legal constraints it poses, which often exceed the limits of the texts, and reflect the overlap of social reality with the technical and objective elements of the disputes.

In his intervention, he concluded that the required is legislative reform and accurate professional practice because the difficulty of restoring the situation to its original state leads to: issuing clear regulatory texts for the implementation phase, adopting technical expertise accompanying each ruling that requires restoration, strengthening the powers of the judicial commissioner in the face of those who refuse or obstruct, and adopting digitization and documentary media (photos, maps, inspection reports) to facilitate the matching of the situation before and after implementation.

A number of judges and judicial counselors from the Marrakech Court of Appeal participated in this meeting, where they analyzed the issue of restoring the situation to its original state, and the complications that this procedure raises related to the reality of the files and the diversity of disputes.

This initiative comes in the context of the Marrakech Court of Appeal's endeavor to modernize judicial work mechanisms, provide opportunities for continuous training, and simplify implementation procedures, in a way that ensures the consolidation of confidence in the judiciary and the achievement of the desired efficiency.
