HIBAPRESS – Chafiq Anouri
Concepción Barrio, President of the General Council of Spanish Notaries, confirmed that the Moroccan real estate system surpasses the Spanish system in relation to rental contracts, where the contract is always drawn up in an official format before a notary to protect all parties.
Barrio said in an interview with the "Herrera in COPE" program that Moroccan notaries were astonished after they noticed that rental contracts in Spain are often not drawn up officially, which creates a state of legal insecurity and a lack of reliable data about the market. Barrio cited a recent Moroccan delegation visit, where she explained that they "were surprised that the rental contract in Spain is not officially documented, because in Morocco this practice is common and protects the rights of the owner and the tenant alike." The President of the General Council of Spanish Notaries added that the intervention of the notary, which can even be done via video, provides complete legal security and guarantees transparency for all parties. Barrio explained that the Moroccan approach allows for the acceleration of procedures and the protection of rights, unlike the Spanish system, which leaves the parties without official guarantees, stressing that the protection of both parties is essential, because it concerns "a person's property and another person's housing", and that "housing is a person's home" whether owned or rented. In this context, the Spanish Notaries Syndicate launched a new statistical platform to provide data on real estate prices, but it acknowledged that the Spanish system is still behind compared to Moroccan practices in ensuring legal security and the official documentation of rental contracts.
