The Commercial Primary Court of Casablanca issued a final ruling (number 13524) obligating a banking institution to compensate a customer with 5000 dirhams after the ATM at one of its branches retained his bank card for four days, depriving him of its use.
The court also charged the bank with the costs of the lawsuit and rejected the remaining requests, even though the branch located on Hamman Al-Fatouaki Street was closed due to construction when the ATM swallowed the bank card. The court affirmed that keeping the ATM running while the branch was closed and neglecting to provide clear notifications constitutes an organizational error and negligence in internal management, considering that depriving the plaintiff of his card constitutes actual damage that warrants compensation in accordance with Articles 78 and 98 of the Law of Obligations and Contracts, even in the absence of direct financial loss.
