HIBAPRESS – Beni Mellal
The works of the National Study Day, organized by the Regional Council of Notaries in Beni Mellal-Khenifra, in partnership with the Court of Appeal in Beni Mellal and in coordination with the Regional Councils of Notaries in Marrakech and Settat, under the title: "Contractual and Digital Security and the Protection of Personal Data: Challenges and Prospects" concluded in the city of Beni Mellal on Thursday, November 20, 2025.
This meeting was attended by judges, notaries, experts, and representatives of specialized national institutions, who discussed current problems related to digital security and the protection of personal data and the role of the notary in enhancing contractual security and consolidating trust in transactions, in addition to highlighting the role of the judiciary in consolidating judicial security as the basis of legal security. During this study day, the notaries and judges affirmed their full and responsible involvement in the major projects launched by His Majesty the King, especially those aimed at strengthening legal, digital and social security in the Kingdom. This involvement includes supporting the digitalization project and modernizing the documentation and judicial structures, protecting personal data and safeguarding the right to privacy, and consolidating transparency, integrity and trust in contracts and transactions, in addition to qualifying legal human resources to keep pace with rapid transformations. The participants concluded with a number of practical recommendations, including those related to the legislative system, where a call was made to correct the Arabic translation of Article 418 of the Law of Obligations and Contracts in accordance with the original French text, and to expedite the amendment of the law regulating the notary profession in order to integrate the electronic signature and the secure remote electronic signature, and to review Article 889-1 so that the official agency produces its legal effects between the parties immediately upon acquiring official status, and for third parties from the date of its registration in the special register. The participants also called for strengthening digital security, by establishing a special professional insurance for cyber risks to protect the digital archive, and developing institutional cooperation with the National Commission for the Protection of Personal Data. With regard to real estate transactions, the meeting recommended the establishment of a national electronic register for preliminary contracts and promises of sale, and the review of the texts regulating registration in the real estate registers to distinguish between the legal effect of the official contract between the parties as soon as it is official, and its effect towards third parties from the date of registration in the real estate record. A real estate guarantee fund was also called for to compensate victims of fraud or forgery and enhance the legal protection of those registered in good faith, by amending Article 2 of the Code of Real Rights. At the end of this meeting, the participating notaries and judges renewed their loyalty to the glorious Alawi throne, confirming their permanent adherence to the lofty royal directives, and their continued joint work in order to consolidate the state of law, enhance legal and digital security, protect the rights of citizens, and strengthen confidence in institutions and transactions.
