HIBAPRESS – Khalil Fazzazi
The file of the Housing and Social Association for employees of the Ministry of Health and Social Protection in the city of Laayoune has entered a new phase, after the court decided to consider the case ready for deliberation, setting next November 3 as the date for it, pending the issuance of a ruling on the dispute over the legitimacy of the association's management and its organizational and financial future.
According to the data provided by the party that initiated the judicial proceedings, a set of documents and papers were presented to the court, which the concerned party stated relate to potential irregularities in the association's management, including what it described as changes to the basic law, as well as a discrepancy in the reported number of members, which was initially stated to be around 1806 members, compared to 1233 members in another stage.
The issues raised also include the matter of continuing to open membership after the legal term of the administrative office expired, in addition to attempting to hold a general assembly which the same party states did not adhere to the legal regulations governing this process.
This comes in the context of an ongoing dispute over the legitimacy of the administrative office and the methods of managing the association's affairs, in addition to demands related to members' rights to access documents and data related to management, and the extent to which the legal and regulatory rules governing the body's work are respected.
In a parallel development, the same data indicated that a request was submitted to the judiciary to take precautionary measures regarding the members' funds, with the aim of preserving financial contributions until the legal and organizational status of the association is resolved.
According to the party submitting the request, this step aims to protect the rights of the members and preserve their funds, pending the possibility of establishing a new association that includes men and women from the health sector, providing an organizational framework for managing their affairs and resolving existing issues.
This request comes in light of previous disputes regarding the call for a general assembly to renew the administrative office, the extent to which the legal term was respected, as well as the controversy related to member lists and the documents organizing the work.
With November 3 set as the date for deliberation, all eyes are on what the court will decide regarding the demands and defenses presented to it, and the legal implications that may result from the ruling on the future of the association, its management methods, and its members' funds.
Pending the issuance of the judicial decision, the allegations related to management and legal documents remain subject to judicial review, without being considered established irregularities before the court rules on them, while the awaited ruling remains a crucial stage for clarifying the legal and organizational status of the association and safeguarding the rights of the concerned parties.
